Aerotel v. Telco Decision PDF Print

A decision was recently issued by the Federal Circuit in Aerotel v. Telco (Docket No. 2010-1515), in which the Federal Circuit affirmed the judgment of non-infringement in favor of our client, Telco Group, Inc.  A copy of the decision is attached. The firm represented Telco in this action since it was filed in 2004.  In this case, Plaintiff brought an action for infringement of a patent relating to a system and method for making prepaid telephone calls, and sought damages from Telco in the tens of millions of dollars.  After a claim construction hearing, the District Court construed all claims in favor Telco.  After consenting to entry of judgment in Telco’s favor, Aerotel then appealed the district court’s claim construction as to one claim only.  The Federal Circuit affirmed the portion of the claim construction which supported the judgment of non-infringement by Telco.  Also attached is an article appearing in IP360 today which  reports the decision.  The appeal was argued by Robert T. Maldonado with William E. Pelton and Tonia A. Sayour assisting on the briefs.

Supreme Court Issues Favorable Decision PDF Print

The U.S. Supreme Court has issued a decision in favor of SEB S.A., a French home appliance manufacturer, in the case of Global-Tech Appliances, Inc. v. SEB S.A., ___ U.S. ___; 2001 WL 2119109 (2011).  Interpreting Section 271(b) of the Patent Law, the Court held that inducement of infringement requires knowledge that the induced acts constitute patent infringement, and such knowledge can be established by acts of willful blindness.  The Supreme Court's decision affirms a Judgment based on a jury verdict awarding SEB more than $5 million in damages for patent infringement.  SEB was represented at the trial by Cooper & Dunham lawyers Norman Zivin, Wendy Miller and Gregory Carbo, and was represented by Mr. Zivin and Ms. Miller before the Court of Appeals for the Federal Circuit and the Supreme Court.

Cooper & Dunham was a sponsor at the 30th Anniversary Gala Benefit Auction of Community Impact, a service organization at Columbia University on Monday, April 11, 2011.  The event was held at JP Morgan Chase Corporate Offices on Park Avenue.

Community Impact is the largest service organization on Columbia University’s campus. They serve 8,000 people of all ages—from children to adults—through a comprehensive array of services. Community Impact’s work is delivered by 900 students, overseen by 11 staff members; all in partnership with 100 community agencies.
